Intellectual Property Litigation

Young Conaway has for many years been involved in the litigation of intellectual property disputes in the Delaware courts, in both jury and bench trials.  In these cases we represent national and international corporate clients in patent infringement, trade secret, unfair competition, and trademark infringement disputes.  Drawing upon Young Conaway's many experienced trial lawyers, we are able to provide a full range of intellectual property litigation services, depending on the needs of individual clients and cases.  Our knowledge of the intellectual property issues, combined with our experience in the Delaware district court and Chancery court, make us productive and efficient in resolving intellectual property disputes.

The many types of technology which we have  addressed in our cases include telecommunications, biotechnology, medical devices, computer chips and hardware, software, chemical compounds, and pharmaceuticals.

Practitioners in our intellectual property litigation section have clerked for judges serving on the United States Court of Appeals, United States District Courts, the Delaware Supreme Court, and the Delaware Court of Chancery. Section practitioners have also chaired the District of Delaware Local Rules Committee, participated as members of the District of Delaware Intellectual Property Advisory Committee, and one of our practitioners is the current co-chair of the District of Delaware Intellectual Property Advisory Committee.  We also are currently active in drafting the patent jury trial instructions for use in Delaware patent jury trials and serve on the District of Delaware Local Rules Committee, and section members speak at many national seminars concerning intellectual property litigation.  Several members of the section are registered to practice before the United States Patent & Trademark Office.
