About the Section
The Workers’ Compensation Defense Practice within Young Conaway Stargatt & Taylor, LLP offers proactive and aggressive response to workplace injury claims. Our attorneys advise and represent businesses from the initial notice of a workers’ compensation claim through all  aspects of litigation to include appellate appearances before the Delaware Supreme Court.
 
The attorneys within the practice section are well-versed on Delaware’s workers’ compensation laws. This depth of knowledge and understanding allows Young Conaway’s lawyers to assess the legitimacy of claims, identify reasonable settlement options and, when appropriate, take cases before the Industrial Accident Board.
 
The practice section‘s support staff, which includes three paralegals and an administrative clerk, is conversant in all aspects of workers’ compensation, and provide additional resources for client personnel involved in the administration of workers‘ compensation.
 
Philosophy
Young Conaway’s philosophy is that unnecessary litigation should be avoided and that clearly compensable claims should be managed in such as way as to decrease the likelihood of the claimant ever obtaining counsel. As defense counsel, Young Conaway attorneys act not only as litigators in disputed claims, but also as a resource to provide guidance in the management of non-litigation cases. The section firmly believes that claims handlers and senior supervisors who have a basic familiarity with the substantive law regarding workers’ compensation are better equipped to manage cases and address potential claims before litigation arises.
 
Training
Ensuring that claims handlers, supervisors, managers and human resource professionals are aware of legal issues and responsibilities involved in the reporting, investigating, and handling of workers’ compensation claims is the foundation of Young Conaway‘s team approach. To increase awareness, the attorneys in the Workers’ Compensation Defense Practice Section regularly conduct in-house client seminars covering substantive workers‘ compensation issues and developments. In addition, the attorneys meet with several of our self-insured clients on a monthly or quarterly basis to discuss recent cases and to ensure ongoing team cooperation in case management.
